1. Purpose
This Copyright & Intellectual Property Policy ("Copyright Policy") explains how Hetuluka protects and manages intellectual property relating to its platform, educational materials, educators, students, users and third parties.
It applies to:
Website and applications;
LMS;
Courses and educational materials;
Live and recorded classes;
Assessments and assignments;
User-generated content;
Educator-submitted content;
Logos and trademarks;
Certificates and credential systems; and
Other intellectual property used through Hetuluka.
This Policy supplements the Terms of Use.
2. Hetuluka Intellectual Property
Unless otherwise stated, Hetuluka or its licensors own or control the applicable intellectual-property rights in Hetuluka's proprietary materials and systems.
This may include:
Course curriculum;
Course structure;
Videos;
Live-class recordings;
Recorded lessons;
Notes;
Textbooks and educational materials;
Questions and assessments;
Quizzes and examinations;
Graphics;
Software;
Source code;
User interfaces;
Platform designs;
Logos;
Brand assets;
Trademarks;
Certificate designs; and
Other proprietary materials.
The existing Copyright Policy similarly states that Hetuluka or its licensors own platform content and identifies course materials, videos, source code, assessments, textbooks, branding and trademarks as examples.
3. Limited User License
Subject to applicable terms and successful payment where required, Hetuluka may provide you with a limited, personal, non-exclusive, non-transferable and revocable right to access applicable educational content for permitted educational purposes.
This does not transfer ownership of Hetuluka's intellectual property to you.
Unless expressly authorized, you must not:
Reproduce;
Resell;
Republish;
Distribute;
Commercially exploit;
Publicly redistribute;
Record;
Screen-capture or screen-record;
Scrape;
Reverse engineer;
Circumvent technical protections; or
Create unauthorized derivative works
from Hetuluka's proprietary content.
4. Educator Content
Educators may submit or create educational content for Hetuluka.
Unless a separate written agreement states otherwise, educational content submitted by an educator for publication or use through Hetuluka is owned by Hetuluka, subject to applicable law.
Different ownership arrangements may apply to:
Commissioned work;
Employment-related work;
Contracted educational projects;
Institutional/partner content; or
Other written agreements.
Educators must ensure that materials submitted to Hetuluka do not unlawfully infringe third-party rights.
5. Student & User-Generated Content
Users may submit:
Assignments;
Projects;
Comments;
Reviews;
Discussion posts;
Peer-review work;
Images;
Videos;
Documents; and
Other content.
Unless a separate agreement or applicable law provides otherwise, users generally retain ownership of their original content.
However, users grant Hetuluka the rights reasonably necessary to:
Host;
Store;
Process;
Display;
Reproduce;
Transmit;
Moderate;
Secure;
Maintain; and
Provide the relevant educational service.
Users are responsible for ensuring that they have the necessary rights and permissions.
6. Copyright Infringement
You must not upload, publish, distribute or otherwise use content through Hetuluka that infringes another person's intellectual-property rights.
If you believe content on Hetuluka infringes your copyright, you may submit a complaint to:
A complaint should contain enough information for Hetuluka to identify:
The copyright owner;
The copyrighted work;
The allegedly infringing material;
Where the material appears;
The complainant's contact information;
The basis of the complaint; and
Any other information reasonably necessary to evaluate the claim.
Hetuluka may request additional information or documentation.
7. Review & Takedown
After receiving a sufficiently supported complaint, Hetuluka may:
Review the reported content;
Request additional information;
Restrict access;
Remove content;
Preserve relevant records;
Notify the affected user where appropriate;
Contact relevant parties; or
Take other legally appropriate action.
Removal is not necessarily an admission that infringement occurred.
Hetuluka may act where required by applicable law or where reasonably necessary to protect its platform and users.
8. Counter-Notices
Where applicable law provides a counter-notice or restoration procedure, an affected user may submit a legally compliant counter-notice to:
Hetuluka may process the counter-notice according to the applicable legal framework.
Different procedures may apply depending on the jurisdiction and type of claim.
9. DMCA & International Claims
For claims involving the United States DMCA or other applicable international copyright procedures, Hetuluka may follow the applicable statutory process.
Where legally applicable, this may include:
Copyright notices;
Counter-notices;
Content removal;
Restoration procedures;
Repeat-infringer measures; and
Preservation of relevant records.
The existing Copyright Policy expressly contemplated Indian and international copyright frameworks, including the Indian Copyright Act, IT Act Section 79, Intermediary Rules, DMCA, Berne Convention and WIPO Copyright Treaty.
Specific legal requirements may differ by jurisdiction.
10. Repeat Infringement
Hetuluka may restrict, suspend or terminate accounts that repeatedly:
Infringe copyright;
Upload unauthorized material;
Distribute Hetuluka content;
Misuse intellectual property; or
Violate applicable intellectual-property rules.
Serious or repeated infringement may result in loss of course access, account access or certificates, subject to applicable law and contractual terms.
The existing policy provides for suspension or termination for repeated infringement.
11. Hetuluka Trademarks & Branding
Hetuluka's name, logos, branding, trademarks, service marks, designs and related brand assets may be protected by applicable law.
You must not use Hetuluka branding in a way that:
Suggests unauthorized affiliation;
Suggests endorsement;
Misrepresents a partnership;
Creates confusion;
Impersonates Hetuluka; or
Misleads users.
Written authorization may be required for commercial or other uses.
12. Fake Certificates & Credential Misuse
You must not:
Create fake Hetuluka certificates;
Modify certificates;
Alter Certificate IDs;
Misrepresent certificate status;
Sell or transfer credentials;
Claim unauthorized affiliation with Hetuluka; or
Create false verification pages.
Hetuluka may investigate suspected credential fraud and may:
Revoke or invalidate certificates;
Disable verification;
Restrict accounts;
Preserve evidence;
Notify affected parties where appropriate; and
Take legal or other appropriate action.
13. Impersonation & Fake Hetuluka Accounts
You must not impersonate:
Hetuluka;
Its proprietor;
An educator;
An employee;
A representative;
Another student; or
An authorized partner.
Suspected impersonation or fake accounts may be reported to:
or, where relevant:
Hetuluka may investigate and request removal of fraudulent accounts or pages from relevant platforms or service providers.
14. Third-Party Intellectual Property
Hetuluka may use content or intellectual property belonging to:
Educators;
Institutions;
Partners;
Vendors;
Licensors;
Students/users; or
Other third parties.
Such content remains subject to the applicable owner's rights and any relevant agreement.
Users must respect third-party intellectual-property rights.
15. Copyright Complaints Are Not a License
Submitting a complaint does not automatically establish infringement.
Similarly, the existence of content on Hetuluka does not mean that Hetuluka endorses or guarantees the copyright status of every item submitted by a user.
Hetuluka may rely on information and representations supplied by users and rights holders while conducting appropriate reviews.
16. Preservation & Legal Cooperation
Hetuluka may preserve relevant content, account information or records where reasonably necessary for:
Copyright investigations;
Legal claims;
Security;
Fraud prevention;
Disputes;
Regulatory requirements; or
Lawful requests from authorities.
Information may be disclosed where required or permitted by applicable law.
17. No Unauthorized Circumvention
You must not attempt to bypass:
DRM;
Access controls;
Download restrictions;
Technical protection measures;
Certificate verification controls;
Account restrictions; or
Other intellectual-property protections.
Unauthorized circumvention may result in restriction or termination of access and may lead to legal action where appropriate.
18. Policy Enforcement
Hetuluka may take appropriate action against intellectual-property violations, including:
Content removal;
Access restriction;
Account suspension;
Account termination;
Certificate invalidation;
Technical blocking;
Reporting to relevant providers; and
Legal action where appropriate.
The specific response may depend on the nature, severity, evidence and applicable law.
19. Changes to This Policy
Hetuluka may update this Policy as:
Laws change;
New services are introduced;
Copyright procedures change;
New technologies are adopted; or
Platform operations evolve.
The updated version will display a new Effective Date.
